Terms and conditions

These terms govern your use of GambleBid (“the Service”). By using the Service or paying for a listing you accept them. If you do not accept them, do not use the Service.

1. What this service is

GambleBid is a paid advertising leaderboard. Advertisers pay to place a link on a public board, and the order of that board is determined solely by each advertiser's current bid.

We are an advertising platform. We are not a gambling operator, we do not accept wagers, we do not hold player funds, and we do not offer any game of chance or skill. Nothing on the Service is an offer to gamble.

2. Eligibility

  • You must be at least 18 years old, or the legal gambling age where you live if that age is higher, to use the Service.
  • You must not use the Service where doing so would breach the law that applies to you.
  • If you are placing a listing on behalf of a business, you confirm you are authorised to bind that business to these terms.

3. No endorsement and no warranty

Rank reflects payment and nothing else. It is not a review, rating, ranking of quality, or a statement that an advertiser is licensed, regulated, solvent, honest or safe.

We do not verify advertisers. We do not audit their licences, their odds, their payout behaviour or their solvency. Any dealing you have with an advertiser is strictly between you and them, and we are not a party to it.

The Service is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law.

4. Listings and advertiser obligations

If you buy a listing, you represent and warrant that:

  • You own or are authorised to advertise the linked destination.
  • The destination is lawful in the markets where it is offered, and holds any licence that its activity requires there.
  • Your listing does not target, appeal to, or attempt to reach anyone under 18.
  • Your title, description and image are accurate, are yours to use, and infringe nobody's intellectual property.
  • The destination contains no malware, phishing, or deceptive imitation of another brand.

You grant us a non-exclusive, worldwide, royalty-free licence to display the title, description and image you submit, for as long as your listing is on the board.

5. Ranking, payment and refunds

  • Rank is your current bid. Each payment replaces the previous bid, and you pay the full amount of the bid you enter.
  • To outrank another listing you must bid more than its current amount. Ties are broken by which listing reached that bid first.
  • Payments are made in cryptocurrency and processed by NOWPayments, who act as the payment processor. We do not receive, store or have access to your payment credentials.
  • All payments are final and non-refundable. Being outbid, losing rank, drawing a lower Gamble rank, or receiving fewer clicks than you hoped are not refund reasons.
  • Cryptocurrency transactions are irreversible. Sending an incorrect amount, or sending on the wrong network, may result in permanent loss of funds, and we cannot recover them.
  • We do not guarantee any level of traffic, clicks, impressions, conversions or revenue.

6. Gamble placements

A Gamble placement is a discounted, randomized advertising placement. You pay a fixed price and receive a real position on the board; only the rank varies.

  • There is no losing outcome. Every Gamble placement wins a real rank on the board.
  • The eligible rank range and the exact price are shown before you pay. The price is locked for that payment.
  • Each eligible rank has equal probability. The odds are stated as a plain number before payment.
  • The draw is provably fair: a server seed is committed before payment and revealed afterwards, allowing the result to be independently recomputed.
  • A Gamble can move an existing listing to a lower rank. By paying you accept whatever rank the draw assigns.
  • Gamble placements are non-refundable. The rank drawn is the rank received.

7. Removal

Rank and copy both go live automatically on payment. Listings that breach these terms or the rules may be removed from the board without refund. Removal does not refund a bid or a Gamble placement.

  • We may remove any listing at our discretion, including where we reasonably believe it exposes us to legal risk or violates advertising rules.
  • If your listing is removed, your bid is not refunded.
  • You can still edit your copy from your manage link, but edits must also comply with these terms.

8. Acceptable use

You must not:

  • Generate artificial clicks on any listing, whether your own or another's, by any automated or incentivised means.
  • Attempt to interfere with, overload, probe or gain unauthorised access to the Service or its infrastructure.
  • Scrape the Service other than by ordinary search engine indexing.
  • Use the Service to distribute malware, run a phishing operation, or launder funds.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the Service.

To the fullest extent permitted by law, our total aggregate liability to you for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the claim.

We are not liable for any loss you suffer in dealings with an advertiser listed on the board, including any gambling losses.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.

10. Indemnity

If you place a listing, you agree to indemnify us against claims, losses and reasonable costs arising from that listing, from the destination it links to, or from your breach of these terms.

11. Changes

We may change these terms. The current version is always at this address and the date above shows when it last changed. Continuing to use the Service after a change means you accept the revised terms. Changes do not apply retroactively to a listing already purchased.
